Trademark Disputes
This section will help you if you have a trademark claim related to a domain name registered through Host.al's domain name registration service.
Uniform Dispute Resolution Policy (UDRP): The UDRP is a mandatory administrative procedure adopted by the Internet Corporation for Assigned Names and Numbers ("ICANN"). All ICANN-accredited registrars are required to follow the UDRP. Host.al is an ICANN-accredited registrar. All domain name registrants at Host.al are required to submit UDRP-compliant claims under the Host.al Domain Name Registration Agreement. More information about the UDRP can be found at http://www.icann.org/udrp. Copyright Disputes
Host.al provides hosting services in connection with some of its domain name registration services. This section will help you if you believe you have a Copyright claim related to a domain name that uses Host.al's hosting service. Please ensure that Host.al is the website hosting service provider before submitting a Copyright infringement complaint in accordance with this policy. See the "Checking the hosting service" section below for more information on how to determine whether Host.al is providing hosting services.
Notice of Copyright Infringement Complaints
If you believe you have a valid Copyright claim for material in which you hold genuine copyrights, you must send the following information to Host.al's Copyright Agent via email at root-at-sign-host.al with "Copyright Infringement Complaint" in the subject line, or via mail to Host.al, ShqiperiaCom Shpk, P.O. Box 8332, Tirana, Albania. Each notification must include the following information to be valid:
- Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works on a single online page are included in a single notification, a representative list of those works on that page.
- Identification of the material that you claim is infringing or is the subject of infringing activity and that is to be removed or access to which is to be disabled, as well as information reasonably sufficient to permit Host.al to locate the material.
- Information sufficient to enable Host.al to contact you, such as an address, telephone number and, if available, an email address where we can contact you.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notification is accurate, and under penalty of perjury, that you are, or are authorized to act on behalf of, the copyright owner of an exclusive right that is allegedly infringed.
- Your electronic signature.
Upon receipt of sufficient notice, and if you have properly identified the material that you claim is infringing so that Host.al can sufficiently locate the allegedly infringing material, Host.al will remove or block access to the material that you claim is infringing. Host.al will take reasonable steps to send your notice to the alleged infringer and notify them that the material has been removed or blocked.
Objection notice
If you have received a notice that material on your website has been removed, or that access to the material has been disabled due to a notice of alleged copyright infringement, you may send your counter-notice to root-at-sign-Host.al with "Counter-Notice" in the subject line, or by mail to the address provided above. Your counter-notice must include the following information to be valid:
- Identification of the material that was removed or access to which was blocked and the location where the material was located before it was removed or access to it was blocked.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or blocked as a result of an error or misidentification of the material that was to be removed or blocked.
- Your name, address, and telephone number, as well as a statement that you consent to the jurisdiction of the Federal District Court for the judicial district of the state of Washington, or if your address is outside the United States, for any judicial district in which Host.al may be located, and that you will accept service of process from the complaining party or its agent.
- Your electronic signature.
Host.al will provide the complaining party with a copy of your counter-notice upon receipt. Host.al will inform the complaining party that the removed material will be restored to your website, or Host.al will cease blocking access to the material within ten (10) business days, unless Host.al receives notice from the complaining party that it has filed a court order or other legal action to restrict your actions with respect to infringing activities involving the material on Host.al’s system. If Host.al does not receive such notice from the complaining party, Host.al will reinstate the removed material or cease blocking access to it no sooner than ten (10) days and no later than fourteen (14) business days from receipt of your counter-notice.
Repeat offenders
Repeat infringer means individuals or entities that continue to infringe copyright or violate other policy rules after receiving notices of such violations. In the context of internet services, this may mean users who continue to upload or distribute infringing material even after being notified of previous infringements.
Hosting check
Please note that Host.al often does not provide hosting services for a particular domain name or website. In these cases, the material that is allegedly infringing is not located on Host.al's computer servers and the above Copyright Disputes Policy does not apply. When Host.al does not provide hosting services, Host.al does not have the technical ability to remove or disable certain inappropriate materials. In this case, we suggest that you contact the website or the party providing the hosting service to resolve the issue. The IP address of the website in question often indicates the party that may provide hosting services.
